The Rukungiri High Court on Thursday suspended 1 of the 3 cases of MUPA Technical Services Limited against Rukungiri district local government and Kinombe Nyaruzinga Construction Company Limited.
On 10th July 2023, MUPA Construction Company sued Rukungiri district local government for suddenly terminating a contract for the construction of Kebisoni seed secondary school, in the Kebisoni sub-county Rukungiri district.
In the same application, MUPA also sued Kinombe Nyaruzinga Construction Company Limited for invading his site and starting work, thereby asking the court for an interim order restraining Kinombe Nyaruzinga construction company and the Rukungiri district local government from further inference with his construction works.
He also requested a temporary injunction restraining Kinombe and Rukungiri district local government stopping them from interfering with the contract site at Kebisoni Seed Secondary School until the case is heard and issues resolved.
However, the court suspended a case of a temporary injunction, allowing Kinombe Nyaruzinga Company whose works are already at 90% to continue working.
The court will on 20th September 2023 sit to hear MUPA Construction Company versus Rukungiri district local government and Kinombe Nyaruzinga Construction Company for the main case in which the district suddenly terminated its contract with MUPA Technical Services to construct Kebisoni Seed secondary school.
