MUPA Technical Services has sued Rukungiri district Local government and Kinombe Nyaruzinga Construction Company Limited for breaching the Kebison Seed School Contract.

According to the letter seen by our reporter, the case was filed on 11th July 2023 in the high court and the respondents were given 15 days to file their defence which is under Civil Procedures Rules.

The case stems from the new contract which was recently awarded to Kinombe Nyaruzinga Construction Company Limited to finish up the stalled project of Kebison Seed Secondary in Katenga cell Nyeibingo parish Rukungiri district.

The project worth 2.09 billion was 2018 awarded to MUPA Technical Services in 2018 and according to the contract agreement, it was to be accomplished in two years but the construction process was later affected by the outbreak of COVID-19 in 2020.

This forced the contract director Eng. Patrick Mugisha of MUPA technical service to seek an extension from the Rukungiri district local government which granted him another year to finish the project.

In 2022, the contractor later abandoned the site decrying the exorbitant sums of money in terms of taxes which pissed them off to the extent of dumping the project.

This forced the Rukungiri district local government to write to the office of the Ministry of Education and Sports informing the ministry how the contractor abandoned the site before completing all the requirements as it was agreed in the contract.

Later in July 2022, the Ministry of Education and Sports ordered the cancellation of the contract and the recovery of funds advanced to the contractor for failure to accomplish the work agreed to finish the seed school funded by the World Bank in the financial year 2018/2019 under the Inter-Governmental Transfers-UgIFT program.

This forced Rukungiri district Local Government to seek guidance from the Solicitor General who guided them to find a new contractor to finish the project.

They later advertised the contract and on 23rd June 2023 Kinomba Nyaruzinga Construction Company Limited won the bid to finish the remaining work at the site to the tune of 472.864.000 (Four hundred seventy-two million eight hundred sixty-four thousand shillings only).

However, according to MUPA technical services, the site is at 93% complete and the money received before terminating his contract was not worth the work done.

He wants the district to pay him the balance before giving the site to another contractor.
