A retired Uganda People’s Defence Force soldier in Kabale district is facing allegations of land grabbing and illegal demolition of property.
Rtd Lieutenant Bahati Mohammad Kabahena, the former head of discipline at the Internal Security Organisation, is being accused by Mubarak Kwehangana Nsabimaana, the eldest son of Mukidadi Ntamugabumwa, a resident of Kamikira village, Kirigime ward, southern division, Kabale municipality.
Nsabimana claims that Bahati has encroached upon their family land without authorization and is plotting to sell it without their consent.
According to Nsabimana, Bahati is the product of a relationship between their mother, Mayimuna Nyanjara Mukidadi, and another man whom she married after their father’s death in 1961.
Consequently, Nsabimana argues that Bahati is not entitled to the benefits of their family property.
Nsabimana took legal action against Bahati and other parties involved in the unlawful occupation of their family land.
The case is currently before the High Court in Kabale. Despite the ongoing court process, Nsabimana claims that Bahati has persistently attempted to sell the remaining portion of their family land, even though he is not their biological sibling.
Nsabimana further alleges that Bahati recently demolished their family house, which caused him significant distress. Nsabimana sought urgent police intervention during the destruction, but he claims he received no assistance.
As a result of the threats he has received from Bahati, Nsabimana lives in constant fear for his life. He has taken refuge at a relative’s house to ensure his safety.
Fatuma Kiconco, Nsabimana’s in-law, emphasizes the urgent need for a resolution to the conflict within their family, as the current situation is highly undesirable.
Mary Bagamuhunda, the LC1 chairperson for Kamikira village, acknowledges awareness of the conflict. Marry says that the village council previously convened to address the grievances of all parties involved, but they are surprised that the issue has persisted.
When contacted, Rtd Lt. Bahati responded by claiming that Nsabimana is targeting him out of spite for not being his biological brother.
As the conflict remains unresolved, Nsabimana has submitted a petition to the Inspector General of Police, seeking a response to the matter.
