In a significant legal development, the Magistrates Court of Kabale has ruled that there is a prima facie case against Twinomuhangi Angello Bagorogoza, who is charged with theft and obtaining money by false pretenses.

Case Overview

Twinomuhangi Angello Bagorogoza faces serious allegations of theft and fraud. The prosecution accuses him of stealing UGX 440 million from Turyahikayo Rwihunga and Hon. Turyahikayo Kebirungi Paula between October 2020 and February 2021. The funds were purportedly intended for purchasing land at Rwakaraba Plot 35 on Kabale-Kisoro Road, but the accused allegedly misrepresented the transaction.

In addition to theft, Bagorogoza is charged with obtaining money by false pretenses. It is alleged that he deceitfully acquired UGX 440 million from the victims under false pretenses of purchasing land, which he never did.

Court Ruling

During a recent ruling, His Worship Olupot Pascal, Magistrate Grade One, found that there was sufficient evidence to establish a prima facie case against Bagorogoza. This decision indicates that the prosecution’s evidence, including testimonies from ten witnesses and documentary exhibits, has met the threshold required to warrant a defense from the accused.

The magistrate noted that although there are contradictions and damage to the prosecution’s evidence, it is substantial enough for Bagorogoza to provide an explanation. The ruling emphasizes that the prosecution does not need to prove the case beyond a reasonable doubt at this stage, as the defense has yet to present its case.

Legal Implications

A prima facie case is defined as the evidence that, if unchallenged, would be sufficient to convict the accused. The court’s determination means that Bagorogoza must now present his defense or face potential conviction based on the current evidence.

The ruling aligns with established legal principles, where a prima facie case is established when reasonable evidence suggests that the accused could be convicted if no defense is provided. If the prosecution’s case is deemed insufficient at a later stage, the accused could be acquitted.

Next Steps

With the court finding a prima facie case, the trial will proceed to the defense phase. Bagorogoza will have the opportunity to counter the prosecution’s claims and provide his side of the story.

This case continues to develop as both parties prepare for the next steps in the legal process. The court’s decision highlights the ongoing scrutiny of significant financial crimes and the legal system’s commitment to ensuring justice.
