The Kabale Magistrate’s Court has rejected medical documents presented by the defense lawyer of Mr. Twinomuhangi Angello Bagorogoza, citing suspicion of forgery, and has scheduled final judgment in a theft case for 23rd February 2026.

The case was presided over by Grade One Magistrate Her Worship Nyevu Aziiza and involves a complaint filed by Hon. Mary Paula Turyahikayo and Mr. Godfrey Turyahikayo. The complainants accuse Mr. Angello, a former Rukungiri District LC5 aspirant, of theft and illegal conversion of their property.

Court proceedings scheduled for the morning session failed to proceed after the accused did not personally appear. Instead, his lawyer, Advocate Patience Nansiima, appeared on his behalf and presented referral medical documents from Karoli Lwanga Hospital, Nyakibale, claiming that the accused was assaulted by unknown persons on 7th January 2026 and had been under treatment until 26th January 2026, when he was allegedly referred to Mulago National Referral Hospital for further management.

The defense requested the court to postpone the ruling, citing the accused’s deteriorating medical condition.

However, the Senior State Attorney, Julie Najuju, strongly objected to the documents, describing them as suspected forged and fake. She informed court that the documents were received late on 28th January 2026 and raised serious inconsistencies, including mismatched hospital discharge dates and lack of supporting referral documents from Mulago Hospital.

The prosecution further argued that the accused had been publicly seen actively participating in political activities, including campaigning for the Rukungiri District LC5 elections on 22nd January 2026, during the same period he claimed to be critically ill and hospitalized.

When asked by court to produce medical records from Mulago Hospital to confirm the referral, the defense failed to do so, deepening suspicion over the authenticity of the medical documents.

The prosecution also highlighted that the accused has repeatedly absented himself from court for over six months, using what it described as “fabricated excuses” to delay justice. Consequently, the State requested the court to proceed with final determination of the matter and consider issuing a warrant of arrest.

During the session, it was disclosed that the magistrate who had initially been handling the case, Her Worship Milly Chandru, was on official leave. Magistrate Nyevu Aziiza indicated she would consult the previous records from the former presiding magistrate before conclusion of the case.

In her ruling, Magistrate Nyevu Aziiza dismissed the medical documents and officially set 23rd February 2026 as the date for final judgment, emphasizing that no further excuses would be entertained.

The court issued a public notice warning that if the accused fails to appear on the judgment date, the court will proceed in his absence and issue a warrant of arrest.
