NTUNGAMO-High court in Mbarara has commenced hearing of Ntungamo town’s most popular land conflict case in which Kampala businesswoman Ms. Goodler Behakanira widow of the late Joseph Behakanira who died abruptly following accusations of misusing CHOGM funds is accusing former district FDC Women League chairperson Alice Kafoda of acquiring a land title on her land.
Court presided over by Mbarara Resident Judge Allan Nshimye last week scheduled a hearing of the case for August 24th following the conclusion of several preliminary proceedings that have lasted for two years.
Ms. Behakanira through her lawyer Richard Barungi of Barungi, Agaba, and Co advocates sued in the high court against Kafoda and Commissioner land registration after the commissioner ordered for nullification of Behakanira’s title on the contested land over illegalities.
The land along the Ntungamo Rukungiri road was planted with Eucalyptus trees, which the two parties claim were bought from the late Buringa acquiring titles at different times.
Kafoda is said to have bought the land from Buringa and other three different people before applying and getting the little and planting their trees only to see Ms. Behakanira claim the land after the death of Buringa with another land title. Kafoda protested the land tile leading to its cancelation.
Justice Nshimye on Thursday, May 25 set the hearing date for the full hearing of the case on August 24.
